HOW IS THIS JUSTICE?

Too many people want injustice so they get their own way.

The following are causes of injustice:

  1. Judges using anything other than facts, law, and Constitution

Any use of anything other than the actual facts, the law, and the Constitution is malfeasance on the part of the judge.

  2. Judges injecting their own beliefs into a case

Any use of any personal, religious, political, or other belief is malfeasance on the part of the judge.

  3. Bad science or bad logic introduced as fact

Any use of bad science or bad logic in a court case is malfeasance. Any ruling based on bad science or bad logic is tainted.

  4. People are demonstrating to demand a certain outcome to a court case

This is the equivalent of bribing the judge or tampering with a jury. It is obstruction of justice.

  5. The press is clamoring for a certain outcome to a court case

This is the equivalent of bribing the judge or tampering with a jury. It is obstruction of justice.

  6. Politicians clamor for a certain outcome to a court case

This is the equivalent of bribing the judge or tampering with a jury. It is obstruction of justice.

  7. People are threatening to riot to get a certain outcome to a court case

This is the equivalent of bribing the judge or tampering with a jury. It is obstruction of justice.

  8. The prosecutor failed to do the job properly

This can result in an unjust acquittal.

  9. The defense attorney failed to do the job properly

This can result in an unjust conviction.

  10. The attorney for the plaintiff or the defendant failed to do the job properly

This can result in an unjust decision.

  11. Somebody attempts to bribe a judge, a jury, or any other participant in a court case

    This is obstruction of justice.

  12. Single theory of the crime case

Investigators stick to a single theory of the crime which is wrong. This is wrongdoing done to save money.

  13. Expecting police to let criminals attack them

This is bad logic. Police have the right to self defense.

  14. Expecting police to assess the situation in a few seconds

This is bad logic. Police need time to know what is going on.

  15. Civil rights charges and Wrongful death suits

These "second bites at the apple" should be unconstitutional.

LESSONS TO LEARN FROM INJUSTICE ATTEMPTS

The following must be obeyed to prevent injustice:

  1. Nothing other than facts, law, and Constitution may affect court cases

Nothing else should ever be allowed to sway any court.

  2. External pressures must never be allowed to influence a court case

It should be a crime to try to influence a case through personal beliefs, demonstrations, threats, riots, bad science, or anything other than valid testimony.

  3. It is extreme wrongdoing for the news media to take sides in any court case

It should be a crime for the press to try to influence a court case. What the reporter wants is not germane to the outcome of the case.

  4. It is extreme wrongdoing for anyone without all of the evidence to judge any court case

Those without all of the facts have no right to judge.

  5. The attorneys must do their jobs with diligence

Failure to do the job diligently means the other side unfairly wins.

  6. Police must not concentrate on a single theory of a crime

Failure to explore all possibilities arrests the innocent while it lets the culprit get away. Saving money perverts justice.

  7. Police must be allowed to defend themselves against actual and perceived threats

It is the duty of the other person to not appear to threaten the police. People must be taught how to behave in the presence of a police officer to keep from appearing to be a threat. This especially includes children.

  8. The police do not have time to assess the situation when events happen too fast

Too often events happen so fast that police have to figure out what is happening on the fly. Nobody can be expected to understand what is actually happening under such conditions.

  9. It is wrongdoing for anyone to declare that a jury verdict was wrongdoing or tainted without proof

Justice is doing what is right according to the facts, the law, and the Constitution. It is not a matter of someone getting or not getting his own way.

  10. A hung jury is not injustice

It is failure of both sides to prove the case.

  11. An acquittal should totally end the matter

Once a defendant is acquitted, there should be no further trials for civil rights violations or wrongful death suits. These are just ways to cheat the justice system.

  12. Anyone harmed by police who did things that provoked the action has no case

Such acts are contributory negligence and should dismiss any civil rights or wrongful death case. Acts by others that indirectly provoked the action also are contributory negligence and those who committed those acts should be sued with wrongful death.
